Abstract

Contract-based polygamy is a contemporary phenomenon emerging within society through temporary marital arrangements under the framework of polygamous marriage. This practice raises serious legal issues in both Islamic law and Indonesian positive law because it contradicts the principle of permanence in marriage contracts. This study aims to analyze the legal status of contract-based polygamy from the perspectives of fiqh, maqāṣid al-syarī‘ah, and Indonesian national law. The research employs a normative legal method using conceptual, statutory, and maqāṣid approaches. Data sources include the Qur’an, hadith, classical fiqh literature, statutory regulations, and relevant contemporary scholarship. The findings indicate that contract-based polygamy is substantively analogous to nikah mut‘ah, which has been explicitly prohibited in Islamic law. Furthermore, the practice lacks legal legitimacy under Indonesian law because it contradicts the principle of permanent marriage as regulated in Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law. From the perspective of maqāṣid al-syarī‘ah, contract-based polygamy contradicts the objectives of protecting lineage (ḥifẓ al-nasl), human dignity (ḥifẓ al-‘irḍ), and social morality. Therefore, contract-based polygamy cannot be justified under either Islamic law or Indonesian positive law.
